Won six-month trial in Morgantown representing State of West Virginia’s asbestos contaminated buildings against twelve defendants for cost of removal; most significantly, obtained first ever ruling that asbestos is hazardous as a matter of law, upheld on appeal by West Virginia Supreme Court.
With Bankruptcy counsel in Washington State, obtained precedential decision that Canadian homeowners with claims of fraud against seller of defective construction not limited to recovery from Bankruptcy assets.
With Minneapolis co-counsel, settled securities fraud federal court case against major insurance company in connection with investments in oil fields in China.
With national counsel, settled class action property nuisance case on behalf of residents against neighboring Ashland Petroleum.
Won jury trial verdict for wrongful termination of Louisiana distributor/franchisee of chemicals against Ecolab, a fortune 500 Company, leading to settlements for 11 other distributors nationwide.
Won jury verdict on liability of major architectural firm for failure to disclose
presence of asbestos in 15 story building.
Obtained, after initial denial, insurance coverage for Board of Directors of Multi Employer Pension fund in defense of claims of negligence when major Insurance company actuary negligently calculated benefits.
Obtained seven figure settlement of negligence claims against major insurance
